Our next topic from within the world of auto scrap and recycling highlights some unscrupulous salvage car sellers that used manipulation to take advantage of unknowing car buyers.

In a recent article on usedcarnews.com titled ‘Trio faces clocking, title tampering charges’ we were told of the following details: “Florida authorities arrested three people for allegedly using Craigslist to defraud used-car buyers. According to the investigation by the Florida Highway Patrol’s Bureau of Criminal Investigations and Intelligence, Denis Kutsayev & Tamara Kutsayeva, with the help of Renat Kutsayev, advertised old cars on Craigslist and manipulated vehicles’ odometers and other aspects to make the vehicles appear more valuable, before selling them to unsuspecting buyers.[2]

The examination claimed the defendants committed fraud customers by removing the word “rebuilt” from the title of salvaged vehicles, altering the amount of mileage and/or reversing back the odometer. One of the named allegedly altered the odometer mileage of a vehicle from 117K miles to 46K miles before selling it online. Each perpetrator faces charges of title fraud & odometer related-fraud. Denis Kutsayev & Tamara Kutsayeva also face charges for engaging in a scheme to defraud with a financial loss of over than $50,000. If found guilty, Denis Kutsayev faces up to 80+ years in prison, Tamara Kutsayeva faces a max of 55 years in prison and Renat Kutsayev faces up 10 years.” The article can be read in its entirety at this link.

Understanding what is a salvage car or salvage title

Although we are located here in Northeast Ohio, this case is based in Florida; therefore, let’s take a look at the states definitions and laws as it relates to this article. According to usedcars.about.com, FL law is as follows: “Within 72 hours of a vehicle becoming salvage, the owner has to forward the vehicle’s title to the motor vehicle department for processing. If an insurance company pays off on the vehicle as a total loss, he title goes to the insurance company. The company then has 72 hours to send it to the motor vehicle department for processing. There’s an interesting twist to the Florida law. You can’t just dispose of the vehicle. You have to prove it is a total loss. You have to obtain a salvage certificate of title or certificate of destruction. You have to provide the department with an estimate of the costs of repairing the damage for which a salvage certificate of title or certificate of destruction is sought. Only after getting a certificate of destruction can the vehicle be dismantled or destroyed.”[1]
